I've been out of work since late last summer and filed a Pennsylvania, USA claim for UC this month after receiving notification from the IRS that for federal tax purposes, I, and other call center workers of West Telemarketing LP, were employees, not contractors.
I submitted a copy of the IRS determination, 1099, and other documents the PA UC needs to determine whether I am also considered an employee, instead of a contractor, under PA UC law.
I worked at least 16 weeks for the company last year and earned at least $50 per week.
My work with the company ceased because they stopped operating in PA.
It's been almost a year since my last pay from the company and I haven't been employed elsewhere since. I wonder if I can be disqualified for PA UC because I have been unemployed for so long without filing a claim.
*Note: I didn't file a claim because I didn't know I was an employee until the IRS sent the determination letter.
